On the Possibility of Kantian Retributivism
نویسنده
چکیده
One the most potent motivations for retributivist approaches to punishment has been their apparent connection to an ethical background shaped by the Kantian notion of morally autonomous and rational human agency. The present paper challenges the plausibility of this connection. I argue that retributivism subverts, rather than embodies, the normative consequences of moral autonomy, justifying a social practice that conflicts with the considered judgments that the proper recognition of moral autonomy would authorize. The core of my case is the analysis of whether a punishment should be understood as a restriction of a criminal’s freedom properly understood. I argue that the affirmative view faces serious difficulties that have not been, and are not likely to be, resolved by retributivist justifications that draw their support from Kantian moral theory. 1 Assistant Professor of Politics, New York University, e-mail: [email protected]

A New Reading of Kant's Theory of Punishment
There are deep, insurmountable difficulties with the traditional interpretation of Immanuel Kantâ??s writings on the subject of punishment. Although it is undeniable that throughout his published writings on practical philosophy â?? and in particular in his Metaphysics of Morals â?? he consistently advocates for the view that punishment can only be justified as a direct response to an individua...
متن کاملThe Subjective and Corporeal Perception of the Cinematographic Frame According to Kantian Viewpoint
The cinematographic frame is a boundary which separates the image from the external world. From an ontological viewpoint which dates back to Greek philosophy, the boundary of a thing separates it from other things, thus leading to its ontological independence from other things. But, according to this point of view, the being of things as external objects is considered to be free from the impact...
متن کاملRetributivism revisited
I’ll raise a problem for Retributivism, the view that legal punishment is justified on the basis of desert. I’ll focus primarily on Mitchell Berman’s recent defense of the view. He gives one of the most sophisticated and careful statements of it. And his argument is representative, so the problem I’ll raise for it will apply to other versions of Retributivism. His insights about justification a...

The recent efforts to identify and analyse the neo-Kantian roots of logical positivism have primarily concentrated on the impact of the Marburg School on Carnap and Schlick. Among the Marburgers, attention focused primarily on Ernst Cassirer. From among the contemporaries of the neo-positivists he is commonly regarded as their leading representative. In view of the different currents of the man...
متن کاملVoice of the Russian Truth... The thought of F. M. Dostoyevsky in the Russian intellectual-cultural tradition in the post-Kantian philosophical perspective
Cultivated for ages in the Russian intellectual-cultural tradition and community consciousness questions about Russia and formulated within them the questions about the thought and work of F.M. Dostoyevsky remain often symptomatically integrally linked, even mutually co-assuming. As, programmatically assumed by the author of the article, the post-Kantian philosophical perspective illustrates an...
